ZamYaka Fund Terms of Service

Effective Date: 1st August 2025

1. Introduction

These Terms of Use (“Terms”) govern your use of ZamYaka Fund (“the Platform”, “we”, “us”, “our”), a crowdfunding platform operated in Zambia. By accessing or using the Platform, you agree to these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under Zambian law to use this Platform.

3. Role of the Platform

  • Fundraisers: Users who create campaigns to raise funds.

  • Donors: Users who contribute to campaigns.
    We act only as an intermediary platform and do not hold or process donations directly. All payments are made through bank transfers, mobile money, or other methods agreed between donors and fundraisers.

4. User Responsibilities

You agree that you will not:

  • Use the Platform for fraudulent, illegal, or harmful activities.

  • Post misleading or false information about a fundraiser.

  • Violate any applicable laws or third-party rights.

Fundraisers must use all funds raised for the stated purpose of their campaign.

5. Content Ownership and License

You retain ownership of the content you post, but grant us a worldwide, royalty-free license to display and promote it to operate the Platform. You confirm that all content you post is accurate and lawful.

6. Fees

There is no fee to create a fundraiser on the Platform.

A small processing fee (typically 5%) applies only to each donation made through the Platform. In addition, standard mobile money transfer fees or bank transfer charges may apply, depending on the payment method used. These payment processing fees are set by the relevant financial service provider, not the Platform.

The net amount, after deduction of the platform fee and any applicable transfer fees, is sent to the campaign creator.

7. Donor Refunds and Dispute Handling

  • Refund Policy: Donations are generally non-refundable once processed. However, in cases of fraud, technical error, or duplicate transactions, donors may request a refund from the Platform within 7 days of the transaction. All refund requests must include proof of payment.

  • Platform Role: Since we don’t process payments directly, we will review each refund request and determine eligibility in accordance with our policies. If approved, refunds will be made via the same payment method used for the original transaction, minus any applicable processing fees charged by financial service providers.

  • Dispute Resolution: In case of a dispute, both parties agree to first attempt to resolve the matter amicably with the Platform’s support team. If this fails, disputes may be referred to the relevant authorities.

8. Disclaimers and Limitation of Liability

We provide the Platform “as is” without warranties of any kind. We do not guarantee that:

  • Donations will be made to any fundraiser.

  • Fundraisers will use funds as stated.

To the maximum extent permitted by law, we are not liable for any loss, damage, or disputes arising from the use of the Platform.

9. Intellectual Property Rights

All names, logos, slogans, and other brand identifiers displayed on the Platform are trademarks of ZamYaka Fund, whether registered or unregistered, and are protected under applicable trademark laws.

You may not use our trademarks without prior written permission. This includes using them in connection with any product or service not provided by us, or in any way that is likely to cause confusion or mislead the public.

Any trademarks, service marks, or logos appearing on the Platform that are not owned by us are the property of their respective owners, and their inclusion does not imply endorsement or association with the Platform.

10. Modifications to the Terms

We may update these Terms at any time. Any changes will be posted on the Platform, and continued use after changes means you accept the updated Terms.
